prework.ca is operated by Swell Farms Inc., based in Campbell River, British Columbia, Canada. Contact: info@prework.ca
1. Agreement to Terms
By accessing prework.ca, creating an account, or purchasing a report, you agree to these Terms of Service. If you do not agree, please do not use the site or purchase any products. These terms apply to all users, visitors, and customers.
2. Services Description
prework.ca provides land intelligence reports for properties in British Columbia, Canada. Our services include:
- Land Intelligence Reports, delivered as a PDF document and KMZ map pack files sent to your email
- Interactive Map Tool, free to explore for browsing BC land data layers
- Single Report Purchase at $25 CAD per report
- Monthly Subscription at $30 CAD per month for unlimited reports
3. Account Registration
To purchase reports or save maps, you must create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must be at least 18 years of age to create an account and use our services. If you believe your account has been compromised, contact us immediately at info@prework.ca.
4. Pricing and Payment
All prices are listed in Canadian dollars (CAD). Payments are processed securely through Stripe. We do not store your credit card information on our servers.
- Single report: $25 CAD
- Monthly subscription: $30 CAD per month
We reserve the right to change prices at any time. If you have an active subscription, we will notify you of any price changes before your next billing cycle.
5. Subscription Terms
Subscriptions renew automatically each month on the anniversary of your sign-up date. You can cancel your subscription at any time through the Stripe billing portal or by emailing info@prework.ca. Cancellation takes effect at the end of your current billing period. There are no partial refunds for unused time remaining in a billing period.
6. Refund Policy
Because our reports are digital goods generated on demand, they are non-refundable once delivered. If your report fails to generate or is missing content due to a system error, contact info@prework.ca and we will provide a replacement report or a full refund.
7. Data Accuracy Disclaimer
This is important. Please read this section carefully.
Our reports compile data from government and public sources, including DataBC, NASA POWER, iNaturalist, and OpenStreetMap. This data may be incomplete, outdated, or contain errors. We do not independently verify the accuracy of third-party data.
Reports are for informational purposes only. They are not a substitute for:
- A professional land survey
- An environmental assessment
- A geotechnical report
- A legal opinion
- A Qualified Professional (QP) assessment
- Any professional certification or regulatory approval
Parcel boundaries shown in reports are approximate and should not be relied upon for legal or construction purposes. ALR status, riparian setbacks, wildlife habitat areas, and all other regulatory flags must be confirmed with the relevant local and provincial authorities before making any decisions.
Swell Farms Inc. is not liable for any decisions made based on report data.
8. Limitation of Liability
To the fullest extent permitted by law, the total liability of Swell Farms Inc. for any claim arising from your use of our services is limited to the amount you paid for the specific report in question.
Swell Farms Inc. is not liable for any indirect, consequential, incidental, or special damages arising from the use of our services, including but not limited to lost profits, business interruption, or decisions made based on report content.
We are not responsible for the accuracy of data provided by third-party sources, including DataBC, NASA, iNaturalist, and OpenStreetMap.
9. Intellectual Property
Reports purchased from prework.ca are licensed for personal or business use by the purchaser. You may share reports within your organization, but you may not resell, redistribute, or republish reports as a commercial product.
Map data, satellite imagery, and other content within reports are subject to the copyright and licensing terms of their respective sources. The prework.ca name, logo, and website design are the property of Swell Farms Inc.
10. Data Sources and Attribution
Our reports contain information from multiple public data sources. By using our services, you acknowledge the following:
- BC government data is provided under the Open Government Licence, British Columbia
- NASA POWER climate data is subject to NASA's data use terms
- iNaturalist observations are provided under Creative Commons licences
- OpenStreetMap data is provided under the Open Data Commons Open Database License (ODbL)
11. Acceptable Use
You agree not to:
- Scrape, crawl, or use automated tools to extract data from prework.ca
- Use automated scripts or bots to place orders or access the map tool
- Resell or commercially redistribute reports generated by prework.ca
- Attempt to interfere with the operation of the site or its underlying infrastructure
- Use the service for any unlawful purpose
12. Termination
We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behaviour, or use the service in a way that harms other users or our infrastructure. If your account is terminated for cause, you are not entitled to a refund for any remaining subscription period.
13. Governing Law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of prework.ca will be resolved in the courts of British Columbia.
14. Changes to Terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Your continued use of prework.ca after changes are posted constitutes your acceptance of the revised terms.
15. Privacy
Your use of prework.ca is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
